Terms and Conditions
- 1. Booking and Reservations
- a. A boat is reserved only when we have received the completed booking form along with the required deposit and have acknowledged receipt thereof.
Back to top - 2. Hirers
- a. Hirers must be over 21 years of age. Our company takes pride in the service we offer and therefore will hire only to people whom it deems suitable to take charge of the craft.
Back to top - 3. Insurance and Security Deposit
- a. Our boats are insured and we have public liability cover. However we strongly recommend you make your own holiday insurance arrangements as our policy does not cover hirer's personal effects or personal accident.
b. Security Options
i. Security Deposit - You will be required to pay a security deposit of £100 with the balance of your holiday fee. This will be refunded after your holiday has ended providing the boat and its equipment is returned on time, undamaged, clean and tidy and without third party claim against you. In the case of negligence or willful damage, an extra penalty may be incurred. In the event of late return the security deposit will be forfeited.
ii. Waiver of liability - for a single payment of £30 (none returnable) at the time final balance is paid, you can be covered for accidental damage.
Back to top - 4. Maintenance, Repairs, Damage or Breakdowns
- a.Our boats are maintained to the highest standards. However we accept no responsibility for loss of time or expenses incurred through accidental damage to the boat whilst in your charge. No liability can be accepted for loss or damage or expense which occurs as the result of any defect occurring during your cruise unless it is caused by our failure to adequately maintain the boat in a fit state.
In the event that the boat is not available owing to circumstances beyond the company's control (for example damage, breakdown, late return). The company shall endeavor to substitute a boat but if this is not possible the company shall refund any payments made but shall not otherwise be liable and the contract shall be discharged.
i. Any defect must be reported immediately to us.
ii. The hirer must not undertake to have any repairs, adjustments or services without our prior approval.
Back to top - 5. Safety and other rules
- a. For your own safety and comfort and that of other and for safeguarding the boat and canal you must agree;
i. Not to cruise after sunset and before sunrise.
ii. To observe the 4mph speed limit, not to race and not to cruise at a speed which creates a wash or disturbs other waterways users.
iii. Not to take the boat on to sea or tidal waters.
Back to top - 6. Accidents
- a. You as the hirer are responsible for the safe navigation of your boat. In the event of an accident;
i. Obtain and record the names of all parties involved.
ii. Notify the company immediately with full details. DO NOT ADMIT LIABILITY.
iii. In the event of a accident the company may repossess the boat and the hiring contract will terminate without liability on the company.
Back to top - 7. Car Parking
- a. You are invited to park your cars on our car park for the duration of your holiday. However we can accept no liability for any loss or damage to your vehicles.
Back to top - 8. Complaints
- a. The hirer must check the boat and its contents fully on arrival and notify the company of any deficiencies before leaving the mooring.
Having checked and signed the hand over form, the hirer will be responsible for any items subsequently found to be missing or damaged. Should any short comings be discovered by the hirer after leaving the mooring, the company must be notified in order that it may be remedied.The company shall not be liable in any respect of any matters not immediately notified and shall not be liable for any matters notified after the end of the hire period.
Back to top - 9. Exemption
- a. The company shall not be liable for matters arising from any cause beyond the company's reasonable control or not due to the company's negligence or wilful default including (without limitation) death or personal injury of hirers, their crew and passengers. Loss or damage to property, non-fulfilment or interruption of the booking or delays, breakdowns, mechanical problems, defects, damage, restrictions of cruising, obstructions. Storms, floods, drought, ice, shortage of water and other weather conditions.
